The Legal Framework

Whiplash claims in England and Wales are governed by the Civil Liability Act 2018. Minor whiplash injuries lasting up to 24 months are subject to fixed government tariffs set by the Ministry of Justice (MoJ). Claimants can file directly through the Official Injury Claim (OIC) portal or instruct a regulated solicitor to act on their behalf. All medical evidence must be obtained through MedCo, the government-approved medical reporting organisation. Solicitors operating in this space are regulated by the Solicitors Regulation Authority (SRA).

The Claims Process

Once a claim is submitted, the at-fault insurer has 30 business days to respond. If liability is admitted, an independent medical report is arranged through MedCo. The report determines injury duration and whether any minor psychological injury is present. The fixed tariff is then applied by reference to the Judicial College Guidelines and MoJ tariff tables. Special damages — including loss of earnings, physiotherapy costs, prescription fees, and travel expenses — are calculated separately and added to the tariff figure.
